WHAT IS DEFAMATION?

Defamation involves a communication by words, images, video, drawings or other means, of  material which has the effect or tendency to damage the reputation of another.

UNIFORM DEFAMATION LAW

Australia adopted a uniform defamation law in 2006. Prior to this, different laws in different States and territories existed which created inconsistency and uncertainty.

LIBEL AND SLANDER

At common law there is a distinction between libel and slander. Libel refers to defamatory material in a permanent form whereas slander describes defamation in an ephemeral form, such as spoken words.  There is a legal significance to the distinction.
